These End Customer Terms and Conditions (“Terms”) govern your use of Nium’s Services and describe how you and the Platform Provider may use the Services via the Platform. The Platform Provider will determine which Services may be offered to you by Nium via the Platform. These Terms are a legal agreement between you and the applicable Nium entity shown in Appendix B (“Nium”, “we”, “our” or “us”), as further described below.
These Terms apply to the use of some or all of the Services by your Organization or sole proprietorship (“you” and the “Customer”). You hereby accept these Terms by applying for the Services via the Platform. In these Terms, the Customer and its Representatives are collectively referred to as “you” or “yours”.
These Terms consist of the following components:

Interpretation. In the interpretation of these Terms, the following provisions apply unless the context requires otherwise:
Precedence of Terms. If any terms conflict, the order of precedence is:
Updates to these Terms. Nium may modify these Terms from time to time by publishing a revised version on www.nium.com or by notifying the Customer (including notice via the Platform Provider). The modified Terms are effective upon publication or, if stated otherwise, upon notice. If you do not agree, you may terminate your use of the Services.
Authority of the Representative. If you apply for or use the Services as a Representative, you confirm that you have authority to do so on behalf of the Customer.
Service Provider. The Services are provided by the relevant Nium entity in its Licensed Jurisdiction.
Platform Provider. Your use of the Services is facilitated by a third-party Platform Provider; your use of the Platform itself is subject to its own terms and conditions.
Restrictions on Authority of Platform Provider. Unless notified otherwise, the Platform Provider is not licensed to provide payment services or act on behalf of Nium except to transmit information.
Funds provided through Platform Provider. If you provide funds via the Platform Provider, Nium’s responsibility begins only once it has received Cleared Funds.
Business Use Only. The Services are for business use only and must not be used for personal, family, or household purposes.

Privacy and security are very important to us at Nium. This Global Privacy Policy (“Privacy Policy” or “Policy”) is intended to help you understand how we collect, use, and share your personal information when you use our products or services.
Nium refers to Nium Pte. Ltd. and its affiliates and subsidiaries worldwide, including entities operating under the Nium Travel, Ixaris, and Instarem brands identified here (collectively “Nium Group”, “Nium”, “we”, or “us”). This Global Privacy Policy applies to the Nium Group and describes and applies to personal information that we collect, use, and disclose about you when you access or use the Nium websites, mobile application, or other online or mobile service that links to or otherwise presents this Privacy Policy to you (“Site”), including our products and services, as well as your related interactions with us (collectively referred to herein as the “Services”).
You should read this Privacy Policy carefully as it contains important information about your privacy rights and choices. If you do not agree to this Privacy Policy, please do not use the Services.
Nium obtains information about you from various sources. “You” may be a visitor on the Site, a user of our Services, including as a customer of Nium (“Nium Client”) or an end user of a Nium Client (“End Customer”), or a recipient/beneficiary of one of our Services. If you are an End Customer, your use of the Services will also be subject to the applicable agreement between us and the applicable Nium Customer.
We collect the information directly from you when you use our Site and/or Services. This may include identifiers (name, address, email, etc.), government identifiers, employment and company information, payment and financial data, verification and biometric information, and other details provided voluntarily or required by law.
We automatically collect information about your device, IP address, location, browser, and interactions with our Site. We use cookies and similar technologies for analytics, functionality, and advertising, in accordance with our Cookies Notice.
We may receive information from customers, financial institutions, identity verification services, marketing partners, or public sources to confirm identity and prevent fraud.
We may disclose information to affiliated entities, service providers, payment partners, regulatory authorities, or in the context of business transfers, mergers, or as required by law. We may also share anonymized or de-identified information.
Depending on your jurisdiction, you may have rights to access, correct, delete, object, restrict, withdraw consent, or opt out of data sale/sharing. You may contact us at privacy@nium.com to exercise your rights.
We retain information as needed to fulfill the purposes described and comply with applicable law, including anti-money laundering and financial regulations.
We may transfer information globally among Nium Group entities and trusted service providers in compliance with applicable data protection laws.
We maintain administrative, physical, and technical safeguards to protect information, but no system is completely secure.
We do not knowingly collect information from individuals under 16 years old. If you believe we have, contact us at privacy@nium.com.
